StaffLeads Terms & Conditions


These Terms and Conditions (the "Terms and Conditions" or “Agreement”) are between you and StaffLeads and govern your use of and participation in the StaffLeads Active Resume Feed (collectively, the "Program").

"You" or "Recruiter" means the entity identified in this enrollment form, and/or any agency acting on its behalf, which shall also be bound by the terms of this Agreement. Please read very carefully these Terms and Conditions.

  Authorized Uses



The Program enables you to receive resumes from active jobseekers that are targeted by sets of rules incorporated by StaffLeads and defined by you for filtering. You agree that any contact you make with jobseekers delivered through The Program is sctrictly job-position related. Under NO circumstance, may a jobseeker be solicited any service or product that requires any sort of upfront or delayed payment from the jobseeker.

You agree that any position you contact a jobseeker about is a legitimate and legal employment opportunity.

  Recruiter's Responsibilites


You are solely responsible for the selection and use of all filters and rules that are used by The Program to trigger the delivery of resumes to your feed, for contacting the applicant while they are still active, and for maintaining communication with your personal StaffLeads Talent Acquisition Expert to keep a positive and targeted stream of qualified resumes in your feed at all times.

It’s Recruiter’s sole responsibility, AT ALL TIMES, to verify that the Campaigns are setup properly and in a satisfactory manner in StaffLead ’s Program.

  Person's Under 18 Years Old


If you are younger than 18 years old, you are prohibited from registering and using this Program. By using our Program, you warrant to StaffLeads that you are at least the age of 18 or that you are not a "minor" as this term is defined in the jurisdiction where you are domiciled.


  Prohibited Uses


StaffLeads STRICTLY Prohibits: (a) using the program to solicit home business, investment, or any other opportunity that requires any sort of payment from the jobseeker; (b) advertising any illegal in any state where jobseeker may reside; (c) storing resumes delivered through The Program for selling to any other source. Violation of these policies may result in immediate termination of this Agreement, and may subject you to other legal consequences.

  Termination Cancellation


StaffLeads may at any time, in its sole discretion, immediately terminate the Program, terminate this Agreement, or cance your use of any Program resource. StaffLeads will make commercially reasonable efforts to notify you via email of any such termination or cancellation within a reasonable period of time. You may cancel any resume feeds and/or terminate this Agreement with or without cause at any time by deactivating a campaign in the Campaign Manager. Upon termination for any reason, you shall remain liable for any amount due for resumes already delivered.


  Limitations of Liability


In no event will StaffLeads, it’s parent, affiliates and/or subsidiaries, and each respective officers, partners, members, managers, employees and agents be liable to you for any special, indirect, incidental or consequential damages (including without limitation loss of use, data, business or profits or costs of cover) arising out of or in connection with this agreement or the use or performance of the Program, whether such liability arises from any claim based upon contract, warranty, tort (including negligence), product liability or otherwise, and whether or not StaffLeads has been advised of the possibility of such loss or damage. StaffLeads ’S cumulative liability to you, from all causes of action and all theories of liability, will be limited to and will not exceed the fees paid by you to StaffLeads during the most recent ONE (1) month for the Campaign(s) subject of the claim. Without limiting the foregoing and except for payment obligations, neither party shall have any liability for any failure or delay resulting from any condition beyond the reasonable control of such party, including but not limited to governmental action or acts of terrorism, earthquake or other acts of God, labor conditions, and power failures.

 

  Payments


You agree to pay all applicable charges under this Agreement, including any applicable taxes or charges imposed by any government entity, and that StaffLeads may change its minimum pricing at any time. If you dispute any charge made under the Program, you must notify StaffLeads in writing within thirty (30) days of any such charge; failure to so notify StaffLeads shall result in the waiver by you of any claim relating to any such disputed charge. Charges shall be calculated solely based on records maintained by StaffLeads. No other measurements or statistics of any kind shall be accepted by StaffLeads or have any effect under this Agreement.
